Legal and political challenge of Mexico to migrant caravans

Resumen

México es territorio en el cual concluyen diferentes tipos de corrientes migratorias: origen, destino, retorno, y tránsito. El último flujo en mención cobró especial relevancia desde octubre de 2018, con la llegada de la primera caravana migrante integrada principalmente por hondureños. En consecuencia, el objetivo del presente trabajo es analizar el desafío legal e institucional que enfrenta el gobierno mexicano a partir del ingreso de la primera oleada de migrantes a fin de explicar las reacciones del gobierno y sociedad mexicana, y trazar el rumbo que debe tomar la política y la norma ante la realidad que viven los integrantes de este grupo vulnerable. Luego entonces, se utiliza el método hipotético-deductivo para, desde el pensamiento Bauman y con base en el enfoque de derechos humanos, delinear propuestas enfocadas en proteger y materializar los derechos de este grupo vulnerable. Abstract Mexico is a territory in which different types of migratory flows conclude: origin, destination, return, and transit. The last mentioned flow gained special relevance since October 2018, with the arrival of the first migrant caravan composed mainly of Hondurans. Consequently, the objective of the present work is to analyze the legal and institutional challenge facing the Mexican government from the moment of entrance of the first migrant wave in order to explain the reactions of the Mexican government and society, and to chart the political and legal course that must be followed in order face the reality that the members of this vulnerable group live in. Then, the hypothetical-deductive method is used to, from Bauman’s thought and based on the human rights approach, outline proposals focused on protecting and materializing the rights of this vulnerable group.
